High Court rules Moroadi Cholota extradition unlawful

The Free State High Court has ruled that the extradition of
Ace Magashule’s former PA, Moroadi Cholota, was unlawful and that the court has
no jurisdiction to try her.

Cholota's facing fraud and corruption charges alongside Magashule in the asbestos tender graft case.
Judge Philip Loubser found that the State misled US authorities by falsely portraying Cholota as a fugitive.
He says only a justice minister, and not the National Prosecuting Authority, can legally request extraditions.

"The extradition of Miss Cholota from the USA to the Republic of South Africa is declared to have been done unlawfully,” Judge Loubser said in his ruling.
“Secondly, this court does not have the jurisdiction to try Miss Cholota on the offences she is charged with. Cholota, you are free to leave."
