He and his brother Darren are accused of killing logistics company owner Shailen Singh.

Singh was gunned down in Umhlanga in December while seated in his car.

The brothers turned themselves in January.

Darren was granted bail last month, while Ferrel's application was rejected.

Last week, Ferrel appealed the court decision. However, he lost the matter.

He returned to the Durban High Court on Wednesday, seeking leave to appeal the judgment.

State Advocate Krishen Shah has confirmed the appeal was granted, meaning he will now have to convince a panel of three judges that refusing him bail was wrong.
