FITA appeals High Court judgement on tobacco ban

The Fair-Trade Independent Tobacco Association (FITA) wants to appeal last week's High Court judgement - dismissing its challenge of government's ban on the sale of tobacco products.

FITA's lawyers have filed papers in the North Gauteng High Court on Friday - seeking leave to appeal last Friday's decision.
The association had approached the High Court asking it to reverse the cigarette sale ban that's been in place since the end of March.

It argued that because of the addictive nature of tobacco – it should be considered an essential product.
But the court found this argument to be without merit and dismissed the application with costs.
FITA also wants to appeal the cost order.
It says the application for leave to appeal is of public importance and believes it has reasonable prospects of success.
