eThekwini back in court over sewerage crisis

The Democratic Alliance has filed court papers in its legal action over eThekwini's sewerage problem

The legal arguments comes a few days after the city was dragged to court by ActionSA and the Abantu Batho Congress over the same matter.
The DA in eThekwini wants the city to be held accountable for, among other failings, to declare an emergency over its failing sewerage infrastructure.
Addressing journalists in Durban on Wednesday, the party's Dean Macpherson says they've also filed papers with Pietermaritzburg High Court over the city's failure to comply with directives issued by the provincial and national government going back to 2019.

"Having the decision by eThekwini to not report the sewage spills as an ‘emergency’ in terms of section 30 of NEMA a violation of the Act.
"The decision of eThekwini to not file or produce an ‘action plan’ or comply with directives from the provincial and national government issued as far back as January 2019, declared irrational, unreasonable, unlawful and unconstitutional,
"Within one month of the date of order, eThekwini must file a plan to address all non-compliance identified by EDTA and set measurable deadlines for progress.”
