The group's Mila Kakaza says they have informed the departments about the high number of pupils who died in crashes while making the trip from home to school over the years.

She says in some cases girls have also been raped.

Kakaza says they want ensure that all pupils have access to subsidised and safe school transport.

"We have marched and picketed and we have sent a letter to them but they have come back and said that they refusing to provide 12 schools with transport. It is still an issue and we are now forced to resort to court action," she said.

KZN Education's responded. The department's Kwazi Mthethwa says they're consulting their legal team on the matter.

"We can confirm that we have received papers from Equal Education. We have refereed those papers to our legal team and we will therefore take if forward from there," he said.
