The Department of Environmental Affairs told the media in Durban last week that Dean Thompson was cited in court papers in a personal capacity - adding that there could be some consequences for him.

EnviroServ however says it has not received any further charges in relation to the ongoing odour problems at its Shongweni landfill site.

Officials say a guilty verdict in the case could see a fine of up to R10-million or possible jail time.

The Upper Highway community claims fumes released from the landfill pose health risks to them and their families, some are demanding that the site be closed.

Thompson says the company is currently engaged in a six-month plan tabled with the department and community.

He says they're confident the measures will mitigate the problem.

Thompson again reiterated the company's stance that it runs a legally-compliant site, saying he is confident EnviroServ's track-record of being a responsible waste management company will be upheld.

The matter is due to be heard in court on April 11.
