Employers could face legal issues if they bar unvaccinated staff from workplace - expert

As employers across the country mull over their workplace Covid vaccination policies, a labour relations expert says those considering closing the door to the unvaccinated are bound to face legal issues.

Businesses grappling with changes after the outbreak last year are now discussing how to operate with both vaccinated and unvaccinated staff. 

 

Professor Paul Smit from North West University says while many people are still working from home, opinions on the way forward are split thanks to the rollout of the jab.

 

"How does this relate to issues such as freedom of choice, freedom of movement, discrimination if an employer prevents an unvaccinated employee from entry into the workplace or is tricked in movement in any way. It comes with many legal questions. 

 

"Legal and constitutional law experts differ on what an employer can or cannot do.

 

"Different countries have adopted different approaches towards the principles of no vaccine, no entry into the workplace."
