EFF secretary-general can be in parliament after his assault case - Legal expert

A legal expert says EFF
secretary-general Marshall Dlamini is allowed to be a member of parliament
despite his conviction.

Dlamini was sentenced to 18 months in prison for assaulting a police officer during the 2019 State of the Nation Address.
However, the sentence was wholly suspended for five years, unlike in the case of former President Jacob Zuma - who can't be an MP.

Judges Matter Researcher, Mbekezeli Benjamin:
"That is because in the Winnie Mandela judgment, the electoral court says anyone whose sentence has been suspended by the court is not disqualified in terms of section 47. He can still be a member of parliament because his prison sentence was suspended by the court."
