Three people died when shots were fired at the rank in the early morning two weeks ago.

It was a long day in the stand for investigating officer, Major Mandla Dlamini.

In the second session after lunch defence attorney, Jimmy Howse, challenged Dlamini on his affidavit where he said the accused had no business being a the Brook street taxi rank on the day of the shooting as none of them were registered under the Berea Long Distance Taxi Association.

Howse said that although they did not reflect on the database of the transport department, they had business there as the Berea Long Distance Association which they work for, which has four major routes that go from Brook street taxi ranks and one of them to Matatiele which is why they were there to monitor the loading of passengers.

Howse argued that granting bail would be possible as the accused are based in Durban, have families and have no passports.
