Durban cop who fatally shot son to plead not guilty

A Durban police officer who shot and killed his 12-year-old son, after he allegedly mistook him for an intruder, says he plans to plead not guilty to the murder charge he currently faces.

Thirty-nine-year-old Maxwell Luthuli's bail application was heard in the Durban Magistrate's Court on Friday.
The sergeant was arrested on Sunday, shortly after the child died on arrival at hospital.
Luthuli kept his head down as his affidavit was read out in court through his attorney.

He told the court he needed bail so that he could attend his son's funeral in Eshowe on Saturday.
Luthuli also said the incident has sent him into a depression and believes he now requires medical attention.
He's told the court his wife and their other child have also been left extremely traumatised.
The court heard that Luthuli believes does not plan to evade his trial or endanger any witnesses.
