Acting national commissioner, Khomotso Phahlane suspended Ngobeni in May for her alleged corrupt links to Durban businessman Thoshan Panday.

It's alleged Panday financed Ngobeni's husband's birthday celebrations in 2010 for having attempted to stop a prosecution.

It has been more than three weeks since Ngobeni again vacated her office - a week after coming back from suspension after it was lifted by the Durban High Court last month.

Phahlane has applied for leave to appeal the Durban High Court ruling that set aside Ngobeni's suspension.

Her lawyer, Ravindra Maniklal says the matter now rests with the presiding judge.

Phahlane's spokesperson Mashadi Selepe says the matter is between the employer and employee.

"We are using the avenues that are available to us - not forgetting that we always approach this within the confines of the law and that we also have the right to appeal," she said.

Meanwhile, the National Prosecuting Authority announced it will be prosecuting Durban businessman Thoshan Panday over bribery charges relating to KZN police official, Johan Booysen.
