ConCourt hears recusal application by Zuma ‘not frivolous’

The Constitutional Court on Friday heard an application on Jacob Zuma's eligibility to contest this month's general election.
It was brought by the Independent Electoral Commission after the Electoral Court set aside its decision to disqualify the former president from standing in the polls on the basis of his July 2021 conviction and sentence.
Zuma is the number one candidate for the newly formed uMkhonto weSizwe party.

Proceedings started with an application by Zuma's legal representation for six justices to recuse themselves.
They presided over his contempt of court case that led to him being sentenced to 15 months in prison for refusing to appear before the Zondo Commission on state capture.
Zuma's legal counsel, Advocate Dali Mpofu, argued that should the justices not recuse themselves, the main case should be postponed.
"So this is not a frivolous application, it’s an application that's well-thought-out obviously because we could not bring an application of this nature just for the sake of it and so those checks and balances had to be made."
