ConCourt dismisses Zuma's recusal application

Former president Jacob Zuma's application to have six Constitutional Court justices recuse themselves from an election matter involving his candidacy has been dismissed.

The judges presided over his 2021 contempt of court case that led to him being sentenced to 15 months in prison for refusing to appear before the Zondo Commission in state capture.

 

On Friday, the court heard an application brought by the IEC after the Electoral Court last month set aside the Electoral Commission's decision to disqualify Zuma from standing in the elections due to his conviction and prison sentence.

 

But the former president's lawyers got proceedings off with a recusal application.

His counsel, Advocate Dali Mpofu, argued that the justices were humanly not inclined to see anything wrong with their earlier judgement.

 

But IEC's legal representative, Advocate Tembeka Ngcukaitobi, said it's the bench's job to sometimes hear contempt of court matters.

 

"The mere fact that they believe that it is unjust doesn’t make the decision unjust in the eyes of the law. It is a subjective assessment that it’s unjust because he is on the receiving end of It. Many clients who lose cases before this court believe that the court has done so unjustly, but the court cannot be directed and dictated upon by their subjective belief."
