Bonginkosi Khanyile's family says the Fees Must Fall activist wasn't at court on Monday because he's in hospital after falling ill.
They say Khanyile woke up with severe flu symptoms.
A warrant of arrest was issued for the activist after he didn't show up at the Durban Magistrate's Court for his case related to the July unrest.
It's alleged he was one of the instigators of the riots.
The 30-year-old was released on bail if R5 000 in September following his arrest
Family spokesperson Philani Mdluli says they note what happened at court on Monday.
"We are aware that the courts have issued a warrant of arrest which is a normal procedure if an accused person does not appear before the courts on a said date.
"How every if the accused person can be able to give a valid reason including proof as to why he or she couldn't attend court. The warrant of arrest gets reversed."
The National Prosecution Authority (NPA) says the matter has been postponed to February for pre-trial hearings.
