Baby's murder: Court hears mother not 'criminally liable'

The Baby X murder trial has resumed in the Durban High Court.

The three-year-old-girl was found dead at her Chatsworth home three years ago.
It was also later discovered she'd been abused and raped. Her mother and grandmother are on trial for her murder.
The toddler's mother was called to take the stand under oath by Judge Mohini Moodley earlier. She was questioned about a car accident that left her in a coma in 2001.

Her defence lawyer, Murray Pitman argued that because of the crash, she does not have the capacity to be held criminally liable for her actions.
State advocate, Cheryl Naidu believes otherwise. Pitman handed over mental assessments to the judge.
New evidence from a neuro-psychologist is expected shortly.
