Aurora denied leave to appeal ruling

The North Gauteng High Court has denied the directors of Aurora Empowerment Systems leave to appeal its ruling which found them liable for damages worth R1,7-billion after a failed mining deal.
The mismanagement of the Aurora Pamodzi Gold mines led to more than 5 000 workers losing their jobs.
In his judgement Judge Eberhard Bertelsmann says the directors who include have lied from the beginning.
''Aurora was insolvent from the day of its incorporation. All the respondents were aware of this fact at all times. The funding the respondents sought to obtain from Shar and AME was dependant upon several suspensive condition Inter Alia that the respondents control the company listed on the JSE.
''Not one of the conditions set by Shar and AME for the provisions of any funds were ever fulfilled. The bid documents presented to the respondents' liquidators contain several untrue and intentionally misleading statement that constitutes fraud upon the addressees thereof,'' he said.
The directors of Aurora are President Jacob Zuma's nephew Khulubuse Zuma, President Nelson Mandela's grandson Zondwa Mandela as well as Thulani Ngubani, and Fazel and Solly Bhana.
