ANC and MK Party can't claim name, logo - legal expert

A legal expert says neither the African National Congress nor the Umkhonto we Sizwe party can lay claim to the name and logo used by the MK party.
On Wednesday, the ANC dragged the Jacob Zuma lead party to the Durban High Court, alleging it stole its trademarks and symbols.
The ANC also argued that voters could confuse the logos, which bare similarities.
Judgement was reserved in the case.

Karen Kitchen, a specialist intellectual property attorney and trade mark practitioner, says both parties have not registered trademark rights for the logo used by the MK party.
"There are quite a few issues at play, but just based on the pure trademark comparison of these logos - obviously they are identical trademarks or are confusingly similar.
"The logos are not identical but it could create potential confusion amongst voters and the general public in South Africa."
