The party had taken the City, along with other relevant government officials, to court over Durban's sewerage crisis.

Over the past few months, it's resulted in beach closures due to contaminated waters.

A court ruled that both parties should try to find common ground through mediation and for respondents who are yet to file responding affidavits to do so by Friday.

ActionSA's Zwakele Mncwango says the city has no plan on how to address the problem.

"Even us we are shocked that the municipality went out to seek for money to fix infrastructure and we asking for a simple document to say prove to us how you plan to spend this money and how you plan to fix infrastructure, and how you plan to deal with the sewer in eThekwini.

"Now they are telling us 'No, its going to take time for them to do it, but we must wait they are going to do it'. We are saying, 'No, they are playing games'."
