Zuma's Downer recusal application postponed

Judgment in Jacob Zuma's special plea application has been tentatively set down for 26 October.

The former president is seeking the recusal of the prosecutor in his corruption case.


He says Advocate Billy Downer cannot be impartial, and has accused him of leaking confidential information to journalists, among other claims.


Arguments wrapped up on Wednesday, with the State's Advocate Wim Trengove telling the Pietermaritzburg High Court that Zuma's application was based on conspiracy theories.


He's denied that the prosecution team has leaked any confidential information or documents, including Zuma's medical records, to reporters.


But Advocate Dali Mpofu for Zuma concluded by saying their arguments are based on things admitted in affidavits by Downer.


"Undisputed facts speak for themselves. Those are the facts that are taken from Mr Downer's affidavit. Here we are not talking about a risk of misconduct. We are talking about proven misconduct.


"We are talking about abuse of the rights of the accused. We are talking about leaks, discussions with Mr [Sam] Sole. We are talking about the more recent leaks that we have had. We are talking about conducting lectures."
