Specialist questions NPA's decision to re-charge Booysen
Updated | By Christopher Motabogi
Top specialist criminal lawyer, William Booth has challenged legal staff at the National Prosecuting Authority to speak up against developments at the entity.
This comes as former KZN Hawks Boss, Johan Booysen and 27 members of the now disbanded Cato Manor organised crime unit head to court tomorrow to face re-instated racketeering charges.
The Durban High Court lifted the latest suspension on Booysen last year and earlier this year dismissed the Hawk's application for leave to appeal the decision.
The unit says it will now approach the Supreme Court of Appeal on the matter.
Booth says prosecutors must always ascertain if there's a reasonable prospect of successful prosecution.
"That is the test in law that the NPA must consider. And if a high court or two judges of a high court in separate matters have said there's no case against him ( unless there's new evidence that has come forward) on what basis and how can he (Booysen) be prosecuted?" he said.
