Significant rulings expected in state capture case

The North Gauteng High Court in Pretoria is expected to deliver judgment today in the case regarding the report and findings by former Public Protector Thuli Madonsela, dealing with state capture. 

State capture report

The High Court judgment deals with the legal challenge brought by the President into the constitutionality of the Madonsela's State of Capture report. It was released shortly before Madonsela stepped down in October 2016.


The report compels President Zuma to appoint a commission of inquiry to investigate state capture and said such a commission should be headed by a judge chosen by Chief Justice Mogoeng Mogoeng. The High Court is expected to give clarity on whether the President will be able to control way in which such an inquiry should be instituted. 


In a second judgement, the High Court will also rule whether the President should be held personally liable to pay the legal costs incurred - with the application to try and to block the release of the State of Capture report.


The Democratic Alliance's (DA) James Selfe says they are confident the court will rule in their favour. 


"We believe that it is holy inappropriate for the President to appoint a commission of inquiry, since he himself is involved in it", said Selfe.


DA leader Mmusi Maimane is expected to lead a delegation of the opposition party in the court.
