RAF says ‘unethical’ claims by lawyers becoming common problem

The Road Accident Fund says unethical behaviour by lawyers involved in the RAF claims process has become a common problem.

The entity has been reacting to a court ruling that found a Limpopo mother had overexaggerated a claim by over 90%. 

 

The woman made the claim of R11 million on behalf of her daughter.

 

The Limpopo High Court heard that the four-year-old child was hit by a car while walking to a shop in 2015. 

 

The driver rushed the girl to the nearest clinic, where she was treated and discharged the same day.

In her mother's submission, her legal representative argued that the crash would significantly impact her child's future earnings. 

 

Assessments were submitted by various specialists, including psychologists and surgeons. 

 

The judge, however, disagreed and found disparities in the medical reports. 

 

In the ruling handed down last week, the court said that while the child suffered from post-traumatic stress disorder, her injuries were unlikely to impact her school performance or future earnings adversely. 

 

The claim amount was decreased to R800,000.
