Julius Malema back in court

The case against the leader of the Economic Freedom Fighters (EFF) Julius Malema will resume in the Newcastle Magistrate's Court in Kwa-Zulu Natal on Friday.

Malema was charged for violating the Riotous Assemblies Act over comments he made in Newcastle and Bloemfontein.


Malema called on supporters to occupy land because they "needed the land in order to eat and work". 


However, Malema is challenging the constitutionality of the apartheid-era law.


The National Prosecuting Authority's Luvuyo Mfaku says its likely today's case will be postponed to allow for Malema's challenge to be heard. 


"We are busy with the filing of our papers and once it has been heard in the High court and a judgement has been given then we can set a trial date," Mfaku told Jacaranda FM News.
