Hawks loses bid to overturn Booysen ruling

An application by the Directorate for Priority Crime Investigation for leave to appeal the Durban High Court's decision to lift the latest suspension of KZN Hawks Head Johan Booysen has been denied.
Judge Anton van Zyl has ruled there is no reasonable prospects for the application to succeed, saying that was the only basis on which he could grant the application.
Advocate William Mokhari, representing the National Head of the DPCI, argued that Durban High Court Judge Anton van Zyl who set aside the suspension in November did not have jurisdiction to decide on the matter.
In Booysen's application to set aside his suspension in the High Court last year, he stated that the move to suspend him was unlawful and taken for ulterior motives to prevent him from continuing with high level investigations.
Mokhari says the decision on suspension must be dealt with in accordance with thedisciplinary structures of the SAPS.
