Gender commission welcomes Semenya’s ruling

The Commission for Gender Equality says it will continue to heighten activism against what it describes as the discriminatory regulations of World Athletics.

The commission welcomed a recent ruling by the European Court of Human Rights that found the Swiss judiciary failed to give double Olympic Champion Caster Semenya a fair trial.


Semenya challenged a rule forcing her to lower her testosterone levels to be able to compete as a woman.


She's been barred from defending her 800m title since 2018.


The commission's Javu Baloyi says the ruling confirms that Semenya’s right to a fair trial was infringed.


"The courts succinctly pointed out that the limitation of Semenya 's rights is not based on existing law, but rather the regulations of a sporting body. 


"As the CGE, we will be engaging Athletics South Africa, Department of Sports Arts and Culture, and other stakeholders, ensuring that Semenya's right and that of other athletes with differences sex development are allowed to participate both locally and internationally."
