Earlier this month, the Supreme Court of Appeal granted the organisation leave to appeal the decision by the High Court to dismiss its challenge of the ban.

FITA says its legal team and that representing the Cooperative Governance Minister Nkosazane Dlamini-Zuma and the President Cyril Ramaphosa have been having settlement negotiations over the past week.

It says Minister Nkosazana Dlamini-Zuma has promised to follow a public participation process  - should she in future want to suspend the sale of tobacco products again.

Should a consultation process be announced - government has agreed that any interested party will be allowed to take part.

FITA says there's also an agreement that any future sales bans will be done in accordance with the law.
