Expert weighs in on Oscar conviction

A legal expert says it is not uncommon for two judges to see the same matter differently.

Advocate Mannie Witz has been referring to the conviction of Oscar Pistorius. 


The Paralympian's previous conviction of culpable homicide has been upgraded to murder by the Supreme Court of Appeal. 


The court yesterday found that trial judge Thokozile Masipa incorrectly applied the principles of dolus eventualis. 


Witz says it comes down to what aspects of the case each judge focuses on.


"Sometimes you get a split bench, where two judges can't come to an agreement. Supreme Court of Appeals is either three judges or a full bench, which is five.


"So, you either going to have a 5-0, that has happened here. We had a majority decision or you get a 4-1 or a 3-2 in whichever favour. So, that's just the way it works.


"On appeal you're not going to get a split bench or a split decision. You're going to get a final answer, and that's exactly what has happened here," he said.


Reeva Steenkamp's mother, June says justice has now been done.  


She has told Sky News that Pistorius needs to take responsibility for her daughter's death.


"There's no winners here. My daughter's dead. Our family is devastated living without her. His family is devastated and he's responsible for that," she said.
