The ICC is accused of targeting African leaders and not pursuing western leaders who allegedly committed atrocities with the same vigour.

The DA's James Selfe says the party has two reasons to challenge this decision.

"Firstly, it's because we believe that it is procedurally wrong. This is the decision of the South African Parliament and Parliament has not decided to withdraw from it. But more fundamentally, we believe that this decision is against the way in which our whole constitutional order is based and that observance of the human rights rule of law. For those reasons we believe that the court should set aside the decision to withdraw from the ICC and begin the process anew," he said.

South Africa joined several other African countries and began the process of withdrawing from the ICC by notifying the United Nations of its decision in October.
