''Mr Motsoeneng should not be entitled to hold any position in the SABC unless and until the Pulbic Protector's report is set aside or the new disciplinary committee finds in his favour,'' Judge Owen Rogers said.

The acting COO Bessie Tugwana's position was also set aside, but any decisions she took in that position before the judgment on Monday, remain valid.

A new disciplinary committee has to be established, and clear timelines must be kept.

Until those processes are finalised, Motsoeneng's appointment remains invalid.
