ConCourt dismisses MK bid to challenge Mchunu leave

The Constitutional Court has denied the uMkhonto weSizwe Party and former president Jacob Zuma direct access in their application challenging the President's placing of the police minister on special leave.

The MK Party believes Cyril Ramaphosa’s decision to suspend Senzo Mchunu over claims he interfered in police investigations is unlawful.
Ramaphosa appointed a commission of inquiry to probe the damning allegations made by KwaZulu-Natal’s police commissioner Nhlanhla Mkhwanazi.
The apex court heard the application on Wednesday.

Zuma and the MK Party argued that Ramaphosa’s only constitutional option was to fire Mchunu before appointing Professor Firoz Cachalia as acting police minister.
The President's lawyers countered that it would be unconstitutional to remove Mchunu without allowing an investigation into the allegations which the minister has denied.
