Bathabile Dlamini handed 4-year prison sentence or R200 000 fine

Former minister Bathabile Dlamini has been handed a four-year prison sentence or a R200 000 fine after being found guilty of perjury.

She was sentenced in the Johannesburg Magistrate's Court on Friday morning.
Half of the sentence has been suspended.

The former social development minister was convicted last month after she was found to have given false information during a 2017 inquiry instituted by Constitutional Court into the social grants crisis.
"I did take into account, most importantly, the accused's financial means and potential. Therefore, considering a person of a calibre, it is, therefore, this court's view that after all considerations, the following sentence is appropriate, fair under the circumstances," Magistrate Betty Khumalo said.
"The accused is accordingly sentenced to a fine of R200 000 or four years imprisonment, half of the sentence is suspended for a period of five years on condition that the accused is not convicted of the offence of perjury and Section 38 of the Superior Court Act 10 of 2013. No order is made in terms of Section 1 or 31 of the Firearms Control Act 60 of 2 000."

"In terms of Section 309 (B) of the Criminal Procedure Act 51 of 1977, you have a right to appeal against this court's conviction as well as sentence. However, you need to file a leave to appeal to this court either today or within the 14-day period from this judgment."
