Zuma lawyers to argue merits of spy tapes appeal in court

The Supreme Court of Appeal wants arguments in President Jacob Zuma's leave to appeal the spy tapes ruling, to be heard in open court.

The ruling was made a short while ago.


Last week, the Constitutional Court denied hearing the NPA's appeal as the SCA had yet to make a ruling.


Durban-based legal expert Sunil Singh says the SCA decision is most likely something Zuma had been hoping to avoid.

Singh says arguing in an open court, as opposed to arguing in chambers creates an uncontrollable environment where there are elements of surprise.


"When you put your application on paper, it is as for what it is in the written document. But when it goes to open court and it is argued, there are other factors that can be put before the judge, for the purposes of a decision being made. Which may influence the judge one way or the other. And it may be detrimental to the applicant in the circumstances, which is Zuma," he said.
