Outrage as babysitter avoids abuse charge for absurd reason

An American couple is seething after a babysitter admitted to abusing their child, but still managed to avoid criminal charges.

Joshua Marbury and his partner left their one-year-old son in the care of a babysitter for the night, only to return to find him screaming.


The babysitter was asleep on the couch.


The next morning, they realised that the little Jacob was covered in bruises. 


Despite the babysitter admitting to hitting the child, no charges will be filed against the sitter due to an Oregon ruling that has left many confused and angry.


The ruling states that the victim has to prove that the abuse or mistreatment was intentional, and because Jacob can barely speak, there is nothing much that can be done.


His bruises were also not considered damaging enough, according to a Redbook report. 


His father took to Facebook to share his disappointment. 


“After TWO months of waiting we only find out that charges are dropped BECAUSE my one-year-old cannot tell you verbally he was abused and my son did not show he was in pain OR that this person "intentionally" did this. I am SO furious…,” he said in a lengthy post detailing the incident. 


He refuses to accept the ridiculous reason for no charges being brought against his son’s abuser, and hoped his post would go viral to highlight the issue. 


“A dead body can’t tell you who killed them. Yet a baby isn’t held to the same standard because he can’t talk???? Well neither can a dead body. THATS BLASPHEMY. You waited 2 months if not longer to tell us this???? Something needs to be done. NOBODY can just hit a child and more to just get away with it because the child can’t verbally tell you.”
