1. TERMS AND CONDITIONS
1.1 This competition runs from Monday 6 May 2024 – Friday 31 May on East Coast Radio. The promoter of this competition is Johnson & Johnson (Pty) Ltd (Registration number: 1930/002616/07) a company incorporated in the Republic of South Africa and with its principal place of business at 241 Main Road, Retreat Cape Town, Western Cape 7945 South Africa, part of the Kenvue Group of Companies (the “Promoter”).
1.2 All persons entering the Promoter’s Together We Raise ™ Competition” (the “promotional competition”, alternatively the “competition”) and (the “entrants") agree that the competition rules as set out in these terms and conditions are binding on them.
2 IMPORTANT NOTICE
2.1 These terms and conditions and competition rules contain provisions which:
2.1.1 may limit the risk or liability of the Promoter or a third party; and/or
2.1.2 may create risk or liability for the entrant; and/or
2.1.3 may compel the entrant to indemnify the Promoter or a third party; and/or
2.1.4 serves as an acknowledgement of a fact by the entrant.
2.2 The entrant's attention is drawn to these terms and conditions in bold because they are important and should be carefully noted.
2.3 The entrant cannot be a juristic person and must be a natural person.
2.4 Nothing in these terms and conditions is intended to, or must be understood to unlawfully restrict, limit, or avoid any rights or obligations as the case may be, created for either the entrant or the Promoter in terms of the Consumer Protection Act, 68 of 2008 (the “CPA”).
2.5 The entrant acknowledges that by submitting his or her entry to the competition he/she has been given an appropriate opportunity to first read these terms and conditions before entering and that he/she understands and agrees to these terms and conditions.
2.6 All entrants to this promotional competition participate entirely at their own risk. By reading and accepting these terms and conditions, the entrant gives consent to these risks and hereby indemnifies and holds harmless the Promoter, and all affiliate entities within the Kenvue group, their directors, employees and agents of any liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any indemnified party.
2.7 The Promoter, any affiliated entity within the Kenvue group and their directors, members, partners, employees, agents or consultants, the suppliers of goods or services in connection with this promotional competition, or any other person who directly or indirectly controls or is controlled by the above-named parties and their respective spouses, life partners, business partners or immediate family members are not permitted to participate in this promotional competition.
3. RULES OF THE COMPETITION
3.1 The competition is open to all entrants nationally within South Africa only.
3.2 To enter, you need to send us a WhatsApp, along with your name, to 061 700 0800 telling us all about your baby-rising tribe has helped you on your journey as a mom, along with a pic of your favourite JOHNSON’S® Baby product.
3.3 On each Friday, two contestants will be selected to take part in a Quiz in which JOHNSON’S® Baby product related questions will be asked.
3.4 The quiz will be made up of three questions per execution.
3.5 The listener who answers most correct quiz questions wins R3000 and the second runner wins R1000. The listener who wins the quiz will be awarded an additional R2000 if they shared a pic of their favourite JOHNSON’S® Baby product.
3.6 All participants will be awarded a JOHNSON’S® Baby hamper worth R2000.
3.7 All the participants who share their favourite Johson & Johnson baby product will go into a draw to win R10 000 cash.
3.8 The grand prize winner will be announced on Friday 31 May 2024
3.9 JOHNSON’S® Baby and East Coast Radio will not be held responsible for SMS charges, data charges or phone costs incurred while participating in this competition.
3.10 The judge’s decision is final, and no further correspondence will be entered into.
3.11 The prize is not transferrable and cannot be exchanged for another item.
3.12 JOHNSON’S® Baby, and East Coast Radio will not be held liable for entries not received for any reason whatsoever and will not be responsible for network connectivity or hardware issues experienced while participating.
3.13 If a winner chosen does not comply, their entry will be disqualified, and a new winner will be chosen by the radio station.
3.14 In the event that a winner cannot be successfully contacted, is ineligible to accept the prize, or contravenes the terms and conditions of this competition or, and East Coast Radio, the prize will be forfeited.
4. GENERAL
4.1 The Promoter and East Coast Radio reserve the right to amend the terms and conditions as well as terminate (should the Promoter be unable to fulfil its obligations due to a force majeure event including but not limited to strikes, governmental actions, natural disasters or any actual or anticipated breach of any applicable law or regulation or any other event outside of the Promoter’s reasonable control) the Competition at any time. In the event of such termination, all entrants and/or winners agree to waive any rights that they may have in terms of the promotional competition and acknowledge that they will have no recourse against the Promoter, their advertising agencies, advisors, suppliers and nominated agents should these terms and conditions be amended or terminated as contemplated in this clause.
4.2 By entering the competition in accordance with its terms, you are entering a promotional competition for the purposes of the Consumer Protection Act, 2008 ("CPA") and the promotional competition will be conducted in accordance with the relevant provisions of the CPA. Should you win a prize in the competition, you undertake to expeditiously do all things necessary to enable the Promoter/sponsor to comply with its obligations under the CPA including, but not limited to (i) providing such personal information as may be required to facilitate handing over the prize (including providing proof of address and identity number) and (ii) signing receipt of the prize upon its delivery.
4.3 Employees of the Promotor, East Coast Radio, and their immediate family and friends, are not permitted to enter the competition.
4.4 Processing of Personal Information
By your usage of this site, you agree to East Coast Radio processing your
personal information including but not limited to information about your age,
gender, marital status, occupation, qualifications and/or household structure. East
Cost Radio is the Responsible Party for all personal information processed as a
result of Promotional Competition.
4.4.1 You acknowledge and agree that that East Coast Radio may process your personal information for the following purposes:
4.4.1.1 Cross-checking and data enrichment of your personal information;
4.4.1.2 Consumer database storage;
4.4.1.3 Profiling consumers;
4.4.1.4 Generating aggregate insights on the basis of such profiling;
4.4.1.5 Developing algorithms for targeted advertising;
4.4.1.6 Sharing it with authorised third parties;
4.4.1.7 Contacting you to provide you with information about East Coast Radio products and services (including special offers that are tailor made for you);
4.4.1.8 As may be required or authorised by law; and
4.4.1.9 As may be necessary for the pursuing of East Coast Radio legitimate interests or the legitimate interests of the third party to whom it is disclosed.
4.4.2 You consent to the collection, processing, use, recording and/or storage of your personal information, including any special personal information described above and the disclosure of my personal information to the Promoter where required to comply with its obligations under the CPA (as described above), third parties where the processing is necessary for pursuing the legitimate interests of the third party to whom it is disclosed and/or where the third-party processes personal information on East Coast Radio’s behalf.
4.4.3 You further agree that your personal information may in appropriate circumstances reside outside of South Africa, and you hereby agree to the transfer of your personal information to locations outside of South Africa and the use of your personal information in such locations as described above.

4.5 These terms and conditions shall be governed by and enforced in accordance with the laws of the Republic of South Africa.
