Ntlemeza is running out of options

Former Hawks boss, Berning Ntlemeza will approach the Supreme Court of Appeal in Bloemfontein on June 2 in a last effort to overturn the decision to remove him from the post.

He approached the North Gauteng High Court in Pretoria this week after several failed attempts to get an urgent interdict against Police Minister Fikile Mbalula.


Ntlemeza was hoping he would be able to return to work during the appeal process, but failed.


Ntlemeza has been involved in a string of court cases over the past two years, following the ruling that his appointment was irregular and illegal.


On Thursday, the High Court in Pretoria scrapped his application for an interdict, because it was found not to be an urgent application.


Judge Sheila Mphahlele said her court wasn't equipped to make a decision on the validity of his firing as that matter had to be taken up with the Supreme Court of Appeal.


"I am of the view that this matter is not urgent and must be scrapped off the role," Judge Mphahlele said.


Ntlemeza also argued he was suffering damage while being away from work, but Mphahlele disagreed.


"The applicant is earning his full salary and further he is currently not performing any functions attached to his employment. He has also failed to show that he will suffer any serious prejudice by not having a work phone and a car - provided by his employer," the judge said.


The SCA will decide if they will hear the matter in the first place and ultimately - if Ntlemeza could be reinstated.
