It's after the advocate penned a letter to President Cyril Ramapgosa stating that she would be returning to work on Tuesday. 


A parliamentary inquiry into her fitness to hold office found her guilty on charges of misconduct and incompetence, paving the way for an impeachment vote in the National Assembly. 


Mkhwebane stated in her letter to Ramaphosa that she'll remain in office until the end of her term in October. 


She says a presidential minute on her suspension pending a final decision by the committee has expired.

The DA's Glynnis Breytenbach has also weighed in on the matter.


"The Section 194 process will be finalised by the vote in the National Assembly on 11 September, and not before. Ms Mkhwebane, and whomever is advising her, should know that.


"Any return to office prior to those proceedings being concluded will be contra her notice of suspension and must attract embarrassing and undignified consequences.


"Ms Mkhwebane will be well advised to reconsider. She is not doing her own cause any good, nor is she giving any thought to the consequences of her actions on the office she notionally heads.
