The Madlanga Commission is on Friday afternoon hearing a postponement application by lawyers representing controversial North West businessman Suliman Carrim, as it continues efforts to secure his long-awaited testimony.

Medical privacy order

The commission has been trying to get Carrim to testify since he fell ill in April, with several attempts to reschedule his appearance resulting in a series of delays.

The application follows months of delays after Karim suffered a heart attack and ended up in hospital in April.

Since then, each of his scheduled appearances before the commission has been postponed after his doctors declared him unfit to testify.

But commission chairperson Justice Mbuyiseli Madlanga has barred everyone from disclosing Carrim's medical condition, the treatment he's receiving, the healthcare professionals treating him, the medical facility where he's admitted, as well as the residential and business addresses of his family members.

Witness availability issues

At the same time, the commission has questioned whether Carrim is trying to get his testimony postponed indefinitely.

Madlanga has added that the commission cannot simply "hold its breath" waiting for him to recover.

"The crucial issue is that the effect of what we have before us would be that, Mr. Carrim never, ever testifies. So that's a serious issue that needs to be dealt with."
