A former Ukhozi FM radio presenter suspected of instigating the unrest in KwaZulu-Natal and Gauteng last week is due to make his first appearance in court on Wednesday.
"My client has always maintained his innocence and he advised that he never incited anyone," Ngizwe Mchunu's attorney Vusi Khathi said.
Khathi said his client handed himself over to police in Durban on Monday.

"They arranged a team that was coming from Johannesburg. We were advised that they had got a warrant from Randburg and there was a case that was opened at Randburg that he contravened the (gatherings) act of 1966."
Mchunu will appear before a magistrate in Randburg.
"At this stage, they advised us that they need to verify his address here in Durban so they can see he's got a valid address. They will take him to Johannesburg. Now, that is still under investigation. I can't divulge anything," Khathi said.
