MPs on Thursday afternoon debated and voted on a recommendation that Gcaleka, who's been acting in the position, be appointed permanently.

The ANC's Vusumuzi Xaba supported the recommendation.

"Advocate Gceleka was outstanding. You may have your issues with her but don't take away that she demonstrated a clear vision for the job and is a capable and competent person."

Breytenbach told Parliament she did not believe Gcaleka was the right person for the job.

"Other parties will argue here today that Kholeka Gcaleka is an outstanding candidate who has proven herself fit and able to perform the functions of the job required

"Precisely on what basis escapes me. Her very cosy relationship and some say intimate relationship with her boss led to speedy promotions and active support of his role in the capture of the NPA, one cannot leave her role in the Agliotti acquittal without her consideration either."

Some MPs strongly objected to Breytenbach's insinuations.

Speaker Nosiviwe Mapisa-Nqakula agreed and asked her to withdraw her remarks.

"I fully agree with you in fact not only that honourable Breytenbach remember rule 88 with states that 'A person who is dependent on you for an appointment or removal cannot be attacked in that manner in this House. I am not going to allow you to speak, I have ruled."

All DA MPs walked out after arguing that the rule that Mapisa-Nqakula referenced did not apply to Gcaleka as she was not a Member of Parliament.
