Prosecutor labels Fadiel Adams a ‘fugitive’ in Magaqa murder probe case

Adams’ bail application has been postponed to next Wednesday as legal arguments continue over the validity of his arrest warrant and case details.

Fadiel Adams has been formally charged over his alleged interference in the Sindiso Magaqa murder investigation.

The leader of the National Coloured Congress faces two counts of defeating the ends of justice and three of fraud.

The MP appeared in the Pinetown Magistrates' Court earlier today.

Prosecutor calls Adams a fugitive from the law

State prosecutor Zwelethu Mata asked the court for more time, saying there are issues that still need to be dealt with in the interests of justice.

“It's information emanating from all his press briefings, which are pertinent to the stance of the state in the opposition of this case.

“Certain averments were ventilated by the applicant, amongst others, that is, he openly said to the entire public that he's a fugitive. Well, a fugitive, a loose translation really would be somebody running from the law.”

Defence rejects postponement

Defence attorney Bruce Hendricks argued that a postponement cannot be justified.

He says the State has been dealing with the matter for more than a year.

Hendricks says his client approached the Western Cape High Court, where an order was granted directing police to provide him with a copy of the warrant for his arrest.

“Now with respect, Your Worship, that is someone that turns himself to a court to find out is the warrant number one, and number two, what's the basis for the warrant?

“He's not a fugitive from justice. He’s someone that turned to the court.”

Adams' bail application has been postponed to 13 May.

The MP has been accused of meddling with the investigation into the 2017 murder of former ANC youth league secretary-general Sindiso Magaqa.

Magaqa was shot after allegedly exposing corruption in the Umzimkhulu Local Municipality.

Magistrate Gwendolyn Roberson says there is evidence that still needs to be ascertained by the State.

She reiterated that Adams’ detention location would not be disclosed publicly.
